Engie App promotion - Disclaimer


Warranty Direct is offering an Engie Motors dongle on the purchase or renewal of any of its motor warranty products policies purchased from November 15th 2017.


Engie Motors ("Engie") offers vehicle diagnostic services ("Engie Services") via its OBD dongle which is connected to a vehicle's computer port. Data is transmitted via Bluetooth and Wi-Fi to the Engie Application ("App") which runs on compatible paired mobile devices (see Engie terms and conditions for further information on compatible devices).


The dongle is offered free of charge to you, subject to the purchase of a qualifying warranty product. Use of the dongle and Application is subject to Engie's Terms of Use which can be found on the Engie Motors website at https://engieapp.com/terms-of-use/. You are under no obligation to use the dongle or the App.


Warranty Direct does not warrant or make any representations regarding the use of the dongle, the App and/or the App Services provided Engie or third parties or any user generated content produced as a resulted of your use of the dongle, App and/or Engie Services. Warrant Direct gives no warranty of any kind, express or implied, including but not limited to warranties of title or non-infringement or implied warranties of use, merchantability or fitness for a particular purpose or use. Warranty Direct disclaims and makes no representations or warranties as to the accuracy, quality, availability, reliability, suitability, completeness, truthfulness, usefulness, or effectiveness of any content available on the dongle, App or Engie Services. The use of the dongle, App and Engie Services is entirely at your own risk and Warranty Direct shall have no liability relating to such use.


Warranty Direct does not warrant that the operation of the dongle, App or Engie Services is or will be secure, accurate, complete, uninterrupted, without error, or free of viruses, worms, other harmful components, or other program limitations.


Limitation of liability and indemnification


Warranty Direct shall not be liable for any damages whatsoever, including, but not limited to, direct, indirect, special, incidental or consequential damages of any kind, whether it was caused consequently or in connection with the use of the dongle, App or Engie Services, including the services and help that are provided or sold by third parties, including via the Engie Services or the user generated content, or any other information generated by your use of the dongle, App or Engie Services.


You agree to defend, indemnify and hold harmless Warranty Direct from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to legal fees) arising from: (a) your use of the dongle, App and/or Engie Services; (b) your violation of any term of the Engie Terms of Use; (c) any damage of any sort, whether direct, indirect, special or consequential, you may cause to any third party which relates to your use of the dongle, App and/or Engie Services (including your violation of any third party rights); and (d) any claim for financial remedies or other compensations due to a decision that was taken or not taken or any action that was made or not made based on the content, output or any other data resulting from the use of the dongle, App and/or Engie Services.


Right to withdraw promotion


Warranty Direct reserves the right to withdraw the availability of this promotion to any customer at any time without prior written notice.
